A defendant shall be punished by imprisonment for not more than ten months.

Seized evidence No. 1 shall be forfeited from the defendant.

Punishment of the crime

On December 5, 2014, the Defendant was sentenced to six months of imprisonment with prison labor for larceny, etc. at the Seoul Northern District Court (Seoul Northern District Court) on March 2, 2015.

As the defendant had experience in working in the elevator maintenance and repair company, he operated the elevator with the knowledge that the first floor of the newly built multi-household house can get off from the elevator and enter the house immediately, thereby attempting to steal money and valuables by entering the upper floor of the multi-household building.

1. Larceny and intrusion upon residence;

A. On November 6, 2016, the Defendant came to the residence of the victim D of multi-household house 501 located in Sinung-si, Seoul, around 12:00 on November 6, 2016. The Defendant: (a) opened an elevator entrance using the keys from the elevator of the above building to the 3rd floor; (b) opened the elevator on the elevator’s second floor; and (c) opened the elevator on the elevator by the manual operation method; (d) intruded the victim’s house; (b) opened the elevator on the upper floor; and (c) opened the elevator on the top of the elevator by the manual operation method; and (d) opened the 10,400,000 won of the market price, which was owned by the victim under the head of the Ansan-si, the sum of the market price of which is approximately KRW 2,200,000,000,000, 1,000 won and KRW 1,70,000.

B. On November 17, 2016, the Defendant infringed upon the victim’s house at around 12:00 by the aforementioned method, and subsequently stolen money and valuables worth approximately KRW 8.8 million in total, including 2,400,000,000, the total market price under the victim’s possession, which was kept in custody at the inside and outside of the said place, and KRW 5,700,000,000,000,000,000 won in total, and approximately KRW 6,000,000,000,000,000,000 won in market price.

2. On November 22, 2016, the Defendant who intrudes upon his/her residence came into the residence of the said victim D, and by the said method.
