A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date of the final judgment.
Reasons
Punishment of the crime
1. On April 21, 2014, at around 00:05, Defendant C, and D jointly joined a G warehouse managed by the victim FF in Gwangju-si, Gwangju-si, and C opened an unlocked window, and the Defendant entered the said window into the warehouse and opened a lock door, C, and intrudes into the warehouse through the open door, and D intrudes into the warehouse, and C took off a computer at the vicinity of the entrance, and C took 80,000 won of the market value of the victim’s possession on the door.
2. The Defendant and C have stolen another person’s mobile phone device and copied it as an official machine.
Around 23:08 on May 19, 2014, the Defendant and C jointly cut off nine cell phoness in total of the market price of KRW 7,400,000,000, from around eight times until June 4, 2014, including the fact that the Defendant and C collected Samsung Galtho-si mobile phone devices equivalent to KRW 80,000, the market price of the victim’s ownership on the carter, from around eight occasions, as shown in the attached Table 1 of Crimes List, at the Jel operated by the victim I in Seongbuk-si, Sungnam-si.
3. On May 2, 2014, the Defendant and C conspired with the use of stolen credit cards to purchase 3 Madices in K located in Seongbuk-gu, Sungnam-si around 19:57 on May 22, 2014, the Defendant and C, as if they were the legitimate holder of the Madice’s national card, such as the No. 1 listed in the annexed List 2, provided that they were the lawful holder of the Madice’s credit card, and issued the above credit card to the employees under their name and put a signature on the signature column of the sales slip, and signed the sales slip at least 81,000 won of the market price, and received 3 Madice tobacco from the above employees from May 29, 2014, from that time to May 29, 2014, goods equivalent to the total market price of KRW 1,560,350 won over 16 times, as shown in the annexed List 2.
