1. The Plaintiff (Counterclaim Defendant) against the Defendant (Counterclaim Plaintiff), B, C, D, E, F, and G:
(a) The area is not less than 1,399 square meters of forest land in Gosung-gun, Gangwon-do.
Reasons
1. Basic facts
A. On November 20, 2012, L 1) L is a 12,571 square meters of the Gangwon-do Gosung-gun K forest (hereinafter “K forest before division”).
2) On December 26, 2012, L filed an application for permission to convert a mountainous district to newly build a single house of 10 square meters on the part of K forest, 9,850 square meters prior to subdivision, and obtained permission for conversion of a mountainous district by setting a period for exclusive use from the Sungsung-Gun Office up to June 30, 2014; a site area of a mountainous district is 9,208 square meters and a road is 642 square meters, respectively.
(3) On January 29, 2013, K forest land prior to the division (hereinafter “instant primary permission”) is 9,850 square meters of K forest land (hereinafter “K forest land after the division”)
J 2,721 square meters of forest and J 2,721 square meters (hereinafter referred to as “J J forest before division”).
4) After the division, Defendant H Co., Ltd. (hereinafter “Defendant Co., Ltd”) completed the registration of ownership transfer on July 6, 2015 with respect to K forest land after the division.
B. On January 30, 2013, the Plaintiff entered into the instant sales contract (i.e., the instant sales contract) with respect to the amount of KRW 80 million with respect to the amount of KRW 1322 square meters out of L and J forest before subdivision as of January 30, 2013 (hereinafter “instant sales contract”).
at the time of signing the agreement, the following:
1. This contract is a contract for the provisional registration of ownership transfer, and 1,322 square meters in total in area of 2,721 square meters (in addition to drawings) shall be traded.
After two years from the date of the balance, the buyer can transfer the ownership in the future, and it is possible to transfer the ownership in the third party designated by the buyer.
This period may be extended to two years at the cost of the buyer.
2.In the part on access roads (in drawings), the seller shall prepare and submit to the buyer a “written consent to land use”.
3. The seller shall complete the divided survey and terminate the right to collateral security until the payment date of balance.
The Agreement was agreed.
The drawings referred to in the following provisions of the special agreement shall be as shown in Appendix 1.
1. The partition of the parcel shall be possible at the time of completion of the road by the adjacent permitted forest (K forest after the division).
2. The purchaser shall have the total area of 823 square meters.
