A defendant shall be punished by imprisonment for not more than ten months.
except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
[2012 Highest 10232] The Defendant, as the representative director of the Seo-gu Incheon Metropolitan Government D Co., Ltd. (hereinafter “D”), was aware that five promissory notes issued D (21,550,000 won in the name of the representative director of the KJ, the bill number of which is 21,50,000 won in the bill number, G bill number of KRW 30,000 in the bill number of KRW 30,000 in the bill number of KRW 30,000 in the bill number, and the bill number of KRW 25,00,000 in the bill number of KRW 131,50 in the total amount of the bill number of KRW 131,50,00 in the bill number of KRW 25,00 in the bill number of KRW 15, 200 in order to avoid the payment of each of the above promissory notes issued by D.
1. Around May 13, 2012, the Defendant: (a) prepared at the president’s office of D in order to prepare two pages of A4 size blanks; (b) copied three promissory notes (bill number G, H, and I); (c) copied two promissory notes (bill number E, F) on the upper part of other Chapters 1; and (d) borrowed under the same condition as in the official approval color paper for the lower part; (b) borrowed and paid note No. : EF GH I; and (c) borrowed notes on the same condition as five copies of the said note: May 15, 2012; and (d) borrowed notes at a rate of not more than KRW 1,00,000 per note per page; and (e) confirmed that the borrower is responsible for all civil and criminal matters: K, resident number: L, address, and Dong-gu Incheon Metropolitan City.
Accordingly, for the purpose of uttering, the Defendant forged a loan certificate in the name of K, which is a private document on rights and obligations.
2. The Defendant, at the time and place specified in Paragraph 1, drafted a false complaint against K by using a computer.
The complaint stated that "A shall be supplied with goods to K and borrowed five blank bills to K. However, K shall not supply goods, but shall not exceed KRW 10,000,000,000 at the time of issuance of the blank bill.
