A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
On November 30, 2018, the Defendant inserted the phrase “I sell in KRW 100,00,000” on the Internet B bulletin board at a place where it is impossible to identify the place on November 30, 2018, the Defendant made a false statement to the effect that C, who reported and contacted it, will transfer the form of “I will transfer the form of money to their house after confirming the deposit.”
However, at the time, the defendant had the intention to acquire money by iceizing the sale of goods, and even if he has received money from the victim, he did not have the intention or ability to send the above punishment to the victim.
Nevertheless, on November 30, 2018, the Defendant: (a) by deceiving the victim as above; (b) obtained transfer of KRW 100,000 to the D account (Account Number: E) under the name of the Defendant on November 30, 2018 from the victim; and (c) obtained the victim by deceiving the victims by the same method over 11 times during the period from May 15, 2019, as described in the attached list of crimes; and (d) acquired the victim by deceiving the victims by fraud.
In order to publish an article to the effect that "I sell a H pocket book at the Internet B bulletin board on July 11, 2019 at the Seo-gu, Seogbuk-gu, and the defendant's house located in the defendant's house located in Yongsan-gu, and the defendant's house located in subparagraph (G)", "I will send a pre-paid ticket to I who reported and contacted it."
