The defendant is punished by imprisonment with prison labor for each other except for the crime of fraud in the case No. 2019Da6526 of the judgment of the court below.

Punishment of the crime

"2019 Highest 5612"

1. Around April 14, 2019, the Defendant: (a) written a notice stating that “F”, which is an Internet used a mobile phone, is sold to KRW 180,000 using a mobile phone at the original room in Incheon, where the Defendant was living; (b) and (c) made a false statement as if the Defendant sent the price of the goods to the victim G who reported and contacted the said notice first.

However, the Defendant did not possess the above goods and did not have any intention or ability to send them even if he receives the price of goods from the victim.

Nevertheless, the Defendant received 180,000 won from the victim to the H bank account (I) in the name of the Defendant for the same day as the price for the goods on the same day, from that time, and received the total amount of KRW 1,705,000 from August 7, 2019 by deceiving the victims five times in total, such as the list of crimes in the attached list of crimes.

2. At around 06:00 on September 17, 2019, the Defendant: (a) discovered that the victim D was locked by laying the 400,000 Aphone8 and the key to the object box at the bottom of the victim’s market price; (b) discovered that the victim D was locked by laying the 400,000 won and the key to the object box on the floor; and (c) cut off the victim’s right by using the said key at the market price of 300,000,000 won and 81 of the said Aphone.

3. Fraud by using computers, etc.;

A. On August 1, 2019, the Defendant purchased 275,000 N2,50 won at the market price by using the victim’s cell phone and by allowing the victim to pay for his/her mobile phone use fees at the same time. At the soup 21:36, the Defendant acquired the same amount of financial benefits by purchasing N2,500 won at the victim’s cell phone value by using the victim’s cell phone and paying for the victim’s mobile phone use fees.
