1. The plaintiff's claim is dismissed.

Basic Facts

The following facts are not disputed between the parties, or may be recognized by considering the whole purport of the pleadings in each entry in Gap evidence Nos. 1, 2, 3, 5, 6, and Eul evidence Nos. 1 and 2:

On September 16, 2002, B Co., Ltd. (hereinafter referred to as “B”) entered into a service agreement with the Defendant with the content that the Defendant will be entrusted with the specialized exhibition service regarding the holding of three exhibitions, including the exhibition (C; hereinafter referred to as “C”), D exhibitions (D; hereinafter referred to as “D”) and the exhibition (hereinafter referred to as “instant service agreement”). Since 2003, the part relating to the instant service agreement relating to the instant case is as follows.

Defendant (A) and B (B) agree to enter into a contract as follows and implement it in good faith in order to have them act on their behalf part of the affairs incidental to the holding of the international specialized exhibition of Party A.

Article 2 (Purpose of Contract) This Agreement shall be concluded to delegate the specialized exhibition services (PES) work for exhibitions as defined in Articles 3 and 4 to B in order to operate more professionally and efficiently the work of international specialized exhibitions hosted or scheduled to be hosted by A, and Eul shall be paid the price therefor.

III.(1) An exhibition to which A delegates a specialized exhibition service to B is: (a) An exhibition to which A entrusts a specialized exhibition service is:

The C Exhibitions (C) that provide specialized exhibition services in accordance with the agreement entered into between A and K-EX and B, respectively.

(b) D Exhibitions (D) held from 2003 by Gap;

C. In relation to the holding of international specialized exhibitions as stipulated in Article 4 (Special Exhibition Services Entrusted by A)(1) of the Exhibitions Act (Special Exhibition Services Entrusted by A) as a new exhibition to be additionally held after 2003, A shall be the following: A shall obtain prior approval from A, if necessary.
