1. The instant lawsuit shall be dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Details of the disposition;

A. On April 8, 1994, the Ulsan-gu B Daesan-gu Seoul Metropolitan Government 2,546.1 square meter (hereinafter “instant site”) was determined and publicly announced as a parking lot in Ulsan-gu, Ulsan-si. On October 21, 200, the Plaintiff submitted a business plan to the Defendant on the instant site to construct a 9th floor and 644 self-stocks parking lot on the instant site, and filed an application with the Defendant for designation of the Ulsan-gu Urban Planning Facility (parking D; hereinafter “instant project”); the self-stocks parking lot to be constructed on the instant site as an implementer; on December 21, 2000, the Defendant determined the date of application for authorization for the instant project by designating the Plaintiff as the project implementer; and on December 28, 2000, notified the Plaintiff as the project implementer under the following notice, stating that the project implementer is designated as the project implementer:

1. Purchase of land before applying for authorization of the instant project implementation plan;
