A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

Where any person intends to import or export goods, he/she shall report to the head of a customs office the name, standard, quantity, price, etc. of the relevant goods.

Nevertheless, on December 2015, the Defendant: (a) received a proposal from Sknman B, stating that it is difficult to detect the metal detection device of a customs house in the face of the gold string in the face of the gold string of 200g to detect the gold string of 200g or 6 (1.2kg) in the face of the port; and (b) tried to transport gold string of 200g to the head of the customs office without reporting it to the head of the customs office as a method concealing five or six (1.2kg) in the face of the 200g weight of the gold string of 200g to the face of the port.

Accordingly, on December 7, 2015, the Defendant, starting from the Republic of China, boarded the aircraft arriving in the Incheon International Airport, entered the Republic of Korea through the entry port, and concealed 1kg (or 4,660,000 won at the market price, 40,740,000 won at the price, and 40,740,000 won at the price) in five gold bars of 200gs, without reporting to the customs office as above, and imported gold bars in collusion with B, C, etc., in a total of 16.4km (or 75,581,200 won at the market price, 683,930,900 won at the price, 205, 208, 2057 at the price of the goods at the price of 25,205, 2057) at the price of the Incheon International Airport, including by December 19, 2016.
