Defendants shall be punished by a fine of KRW 1,000,000.

In the event that the Defendants did not pay the above fine, the Defendants did not pay the fine.

Punishment of the crime

1. Defendant A is a person who operates a mountain village farm with the trade name of D in salary-gun C of the Gyeongbuk-do.

No person shall obtain certification of agricultural and fishery products without agricultural and fishery products from the Minister of Agriculture and Forestry, the Minister of Food and Drug Affairs, etc. by fraud or other improper means.

Nevertheless, around September 19, 2016, the Defendant was subject to the examination of renewal of certification of anti-biotic product products from E’s examiner F, a certification institution designated by the Minister of Agriculture and Forestry for agricultural and fishery products free of agricultural and fishery products, etc., from E’s examiner, and obtained certification of non-biotic product products from G around September 2016, without entering it in the production plan and management-related data (such as feed, animal medicine, disease control register, etc.) while submitting it to F without notifying F of the above facts in the process of on-site examination conducted at the above farm. Around that time, the Defendant obtained certification of non-biological product from E’s aforementioned E’s livestock products from around October 20, 2016 without notifying F of the above facts.

As a result, the Defendant obtained certification from the Minister of Agriculture and Forestry with respect to livestock products with no antibiotics by fraud or other improper means.

2. Defendant B is a person who operates a mountain village farm under the trade name of H from the permanent residence of North Korea to the name of I.

No person shall obtain certification of agricultural and fishery products without agricultural and fishery products from the Minister of Agriculture and Forestry, the Minister of Food and Drug Affairs, etc. by fraud or other improper means.

Nevertheless, around April 2017, the Defendant, at the above I, was subject to the examination of renewal of the certification of anti-biotics livestock products from the J of the E-Appellant, a certification institution designated as the Minister of Agriculture and Forestry for agricultural and fishery products with respect to unregistered agricultural and fishery products, and purchased a single-name "non-registered mixing product", which is an animal medicine, from a person who is not his/her name, around October 2016, to the feed in the field of the mountain of the above farm.
