A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years and six months from the date this judgment becomes final and conclusive.

Punishment of the crime

On October 11, 2019, the Defendant: (a) opened a door that was parked by the victim C at the 1st underground parking lot in Bupyeong-si, Seocheon-si on October 11, 2019; (b) was stolen with approximately KRW 2.3 million in cash owned by the victim; (c) approximately KRW 2.3 million in cash owned by the victim; (d) card sheets, cards, pocketbooks, cosmetics, etc., at the market price of KRW 2,00,00 in KRW 2,30,000 in the market price.

2. On December 28, 2019, the Defendant: (a) reported the “value purchase of the SNS game account” posted in the SNS “SNSbook”; and (b) told the victim F to the effect that “on the advance payment of money, the game account will be transferred” in writing.

However, the defendant only intended to acquire money from the victim for living expenses, and there was no intention or ability to transfer the above game account to the victim.

The Defendant received 400,000 won from the victim to the G bank account in the name of the Defendant for the same day sales proceeds.

Accordingly, the defendant was delivered 40,000 won by deceiving the victim.

3. On January 10, 2020, the fraud Defendant reported “the purchase writing of the E Game Account” posted at H at an unsound place, and told the victim I to “the game account will be transferred if the Defendant received money in advance.”

However, the defendant only intended to acquire money from the victim for living expenses, and there was no intention or ability to transfer the above game account to the victim.

The Defendant received 200,000 won from the victim to the G bank account in the name of the Defendant for the same day sales proceeds.

Accordingly, the defendant was delivered 20,000 won by deceiving the victim.

4. The Defendant, at around April 16, 2019, posted a letter stating that “the Defendant sells the Gu’s grangle” on the J website at a place where the location is unknown, and the Defendant reported this to the Victim K who visited the Defendant.
