A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date of the final judgment.

Punishment of the crime

The defendant is between the husband and wife who is married with the victim B (math, 38) and the father and wife of the victim C (math, 1).

On November 6, 2018, the Defendant: (a) committed violence, around 17:20 on November 6, 2018, in the Michuhol-gu Incheon apartment E residential area; (b) committed a conflict with the victim B; and (c) committed a assault by having a fluort (or tool that cut water necessary for powdering) laid down on the floor of the living room where the victim was located; and (d) having the head of the victim’s head, leading the victim’s head.

Accordingly, the defendant carried dangerous objects and threatened the victim.

3. 아동복지법위반(아동학대) 피고인은 위 1항 기재 일시, 장소에서, 아들인 피해자 C(1세)를 안고 소파에 앉아 있는 처 B의 발치로 부엌칼 등을 집어던지고, 피해자를 안고 있는 B을 안방으로 끌고 가 위험한 물건인 부엌칼 2자루를 B에게 겨누어 위협하고, 이에 겁을 먹고 울음을 터트리는 피해자를 B으로부터 빼앗아 거실 소파에 집어 던지고, 다시 피해자를 들어 작은 방 창문 밖으로 던지는 시늉을 하고, 안방으로 들어가 문을 잠근 후 피해자의 온몸을 두꺼운 이불로 감싼 채 손으로 눌러 피해자로 하여금 숨쉬기 곤란하게 하였다.

Accordingly, the defendant committed emotional abuse that harms the mental health and development of victimized children.
