Punishment of the crime

1. 피고인 C, D의 도박방조 공모범행 피고인들은 형제지간으로서, 필리핀에 서버를 두고 있는 인터넷 도박 사이트인 ‘S’ 사이트에서 룰렛, 바카라, 블랙잭 등의 도박을 하는 동안 이용자가 조작하지 아니하여도 자동진행이 가능한 프로그램을 개발하여 노트북에 설치한 다음 위 노트북을 200만 원 내지 300만 원에 판매하여 이용자로 하여금 S 사이트에서 도박을 함에 있어 용이하게 하고자 공모하였다.

From January 2013 to April 2013, the Defendants conspired to sell Nowon-North Korea, which installed a program developed as above, to B via F, and caused B to go through a total of KRW 2,294,990,000 in total through the accounts in the name of T, etc. managed by the S operator, and let B go through a gambling for “in-house bulletin box” in total 866 times. At the same time, the Defendants aided and abetted the gambling by selling Nowon-North Korea, where a program that facilitates access to and game of the S site was installed, as shown in attached Table 1, and facilitating gambling such as B, etc.

2. On November 29, 2012, Defendant C’s gambling at the Seoul Yangcheon-gu U.S. Building, etc.: (a) visited the said website by obtaining IDs and passwords from the S operator, who is an Internet illegal gambling game site; (b) then, the said website operator wired KRW 200,00 to the corporate bank account under the name of the limited partnership company V, which the Defendant sent in the Defendant’s mobile phone text, and charged the game money equivalent to the same amount; (c) upon receiving two copies of the card, Defendant C her game money in W and X, and her game money in a manner that the sum of two card numbers is close to 9, as shown in the attached Table 2 of the crime committed from around that time to November 1, 2013.
