A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

[2013 Highest 604] The Seoul Olympic Sports Promotion Foundation entrusted a sports promotion betting business with a refund to a person who correctly predicted the result of the sports event in order to create the National Sports Promotion Fund.

No person, other than the entrusted business entity, shall provide property or financial benefits to persons who issued sports betting tickets or similar things and predicted the outcome thereof.

On January 2012, the Defendant: (a) opened and operated the Internet site of the sports promotion betting tickets business in Thailand in Thailand in Thailand in order to raise profits by opening and operating the Internet site of C, D, E, F, G, H, and private sports promotion betting tickets business; (b) C was unable to perform the role of managing and operating the Internet site of “I” (J, K, L, and M) and managing earnings and employees; and (c) E was unable to perform the role of withdrawing money in cash while holding the cash card of a new bank account in the name of the N in which the profits of the said site were stored; and (d), H, H, F, G, and the Defendant were in charge of withdrawing money while keeping the cash card of the new bank account in the name of the N.

From January 14, 2012 to December 9, 2012, the Defendant, along with C, D, E, F, H, and G, received money from members of the above site to transfer from members of the national bank account in the name of the Fund, and charged members with the same amount of printing points, and caused members to transfer the same amount of printing points to the members, and provided members with the results of the sports subject to the sports and game type [one-time "morrofing" in which members predicted the success of various sports games outside the Republic of Korea, one-time "bronfing type" in which members predicted the success by giving certain points in advance to the weak team, and one-time "Span social type" in which the results of the competition are predicted in accordance with the special rules set in advance, and one-time "Span social type" in which the results of the competition are predicted to be 5,000 won through one million won (one million won in cash) through one million won (one million won) in accordance with the dividend rate set in the sports site.
