At around 08:30 on August 16, 2020, the Defendant was aware of the fact in the “J” restaurant operated by the victim H in Ulsan-gu, Ulsan-gu, U.S., despite the lack of the intent or ability to pay the alcohol value, etc., as if the Defendant would normally pay the alcohol value, etc., and then, the Defendant acquired pecuniary benefits equivalent to the said value by receiving the victim’s 15,000 won, namely, the sum of the market price of one-person and two-generations of swine in the swine in the tin.
