Reasons
1. Basic facts
A. The Plaintiff is a company specialized management business, etc., and the Defendant entered into a contract with the Defendant for vicarious execution of administrative services (hereinafter “instant contract”) on June 12, 2013, with the housing redevelopment and improvement project (hereinafter “instant project”) under the Urban and Residential Environment Improvement Act, which promotes the Housing Redevelopment and Improvement Project (hereinafter “instant project”) as a housing redevelopment and improvement project partnership under the Housing Redevelopment and Residential Environment Improvement Act, which was approved by the original city on October 18, 2013 (hereinafter “the Defendant succeeded to the act performed by the Promotion Committee prior to the establishment authorization; hereinafter “Defendant succeeded to the act performed by the association”).
The content of the contract related to the instant case is as follows, and the total business area proposed by the Plaintiff and the Defendant at the time of entering into the contract is 210,435.47 square meters.
Article 3 (Scope of Services) Only upper items shall be stated as the scope of services, and the entry of lower items shall be omitted.
(1) With respect to a redevelopment and improvement project for housing redevelopment B, the following duties shall be performed, consulted, and supported, and the preparation and processing of documents related to the said services shall be governed by Article 69 (1) and relevant provisions of the Act on the Maintenance and Improvement of Urban and Residential Environments:
1. Duties related to the designation of an improvement zone;
2. Vicarious execution concerning the consents to partnership establishment and to rearrangement projects;
3. Vicarious execution of affairs concerning the application for authorization on establishment of an association;
4. Review on feasibility and preparation of a plan for implementing improvement projects;
5. Support for the business to select the designer and work executor;
6. Vicarious execution of affairs concerning the request for a project executor;
7. Vicarious execution concerning the formulation of management and disposal plans;
8. Other assistance and consultation with the partnership related to rearrangement projects.
9. The Plaintiff shall prepare data on the results of the work performed in each stage as CD and submit them to the Defendant, Article 4 (Contract Amount and Method of Payment of Services) ① The service cost performed by the Plaintiff shall be the total floor area of the business ¡¿ 3,000 won/ 3.3 square meters.
