그럼에도 불구하고 피고인은 술에 취하여 정상적인 운전이 곤란한 상태에서 그대로 진행하던 중 피고인 진행방향 전방에서 신호대기 중인 피해자 C(남, 55세) 운전의 D 쏘나타 승용차를 뒤늦게 발견하고 제동하였으나 피하지 못하고 피고인 차량의 앞 범퍼 부분으로 위 쏘나타 승용차의 뒷 범퍼 부분을 들이받아 위 쏘나타 승용차가 전방으로 밀리면서 신호대기 중이던 피해자 E(여, 52세) 운전의 F 옵티마 승용차를 충격하게 하고, 위 옵티마 승용차로 하여금 피해자 G(남, 30세) 운전의 H 모닝 승용차를 충격하게 하였고, 피고인 차량에서 튄 비산물이 위 현장 2차로를 따라 진행 중이던 피해자 I(남, 48세) 운전의 J 택시의 범퍼 부분을 충격하였다.
