Reasons
1. Basic facts
A. C (Death on November 14, 2016) served as the president of the Defendant from February 4, 2004 to May 201, 2014, and supervised the Defendant’s overall business. D, the husband of the Plaintiff, was employed by the Defendant on November 1, 1996, serving as managing director from November 1, 201 to May 201, and took overall charge of the Defendant’s credit business, etc. by assisting C, the president.
B. At around 2006, C invested in F located in Daejeon Seo-gu, Daejeon as a loan from the Defendant, but failed, and began to obtain a loan under the name of tea in order to increase the principal and interest of the loan. As the continuous increase of the loan was difficult to repay, C conspired with G, a real estate development business entity, with G, to obtain a loan of KRW 49,947 square meters of forest land on 13 lots, including Kimcheon-si, Kimcheon-si, and to purchase, develop, and repay the principal and interest of the existing loan obligation with its profits.
C. Accordingly, C and D demanded the Defendant’s employees to lend KRW 4.67 billion in total to a third party who lent C and others (see attached Table 1) on the basis of an appraisal report evaluated as an unfair high-level amount between October 8, 2010 and June 17, 201, by allowing C and D to lend KRW 12.158 billion in total to 12 persons, including C and November 4, 2013, and C and D conspired with the knowledge that loans to the same person are restricted, except in cases where approval is obtained from the head of the I organization, and in addition, C and D conspired to lend KRW 6.5 billion in total between January 25, 2008 and March 20, 2014, respectively.
C and D were convicted of a crime of illegal loan, etc. and became final and conclusive.
