A defendant shall be punished by imprisonment for five years.

Punishment of the crime

On November 18, 2009, the Defendant sentenced the Suwon District Court to imprisonment with prison labor for one year and six months on May 3, 201, and four months on September 22, 201, and completed the execution of each of the above punishment in the Suwon Detention House on September 22, 2011.

On November 16, 2012, the Defendant posted a letter stating that “On-the-counter elf 505,000 won is sold to 450,000 won” at the sales store of the second class music machine by accessing the Internet to the next KafC, at the PC located in Ansan-dong-dong-dong-dong-dong-dong-dong-dong-dong.

However, the Defendant did not have the “ELF 505” but did not have the intent or ability to deliver the “ELF 505” to the buyer even if 450,000 won was paid to the buyer.

Nevertheless, as if the Defendant could send the victim D, who reported and contacted the above writing, with “ELF 505”, he/she falsely speaks as if he/she could send it to the victim D, and he/she received KRW 400,000 from the victim to the new bank passbook (Account Number E) in the name of the Defendant at around 17:44 of the same day.

In addition, the Defendant received a total of KRW 13,650,000 from 7 victims to February 28, 2013, as shown in attached Table (1), from the victim 7 to the victim’s total of KRW 13,650,00, as shown in attached Table (1).

On February 10, 2013, the Defendant posted a notice to the victim F’s intent to purchase a middle and high-speed 107 KEF by accessing the Internet “G” website at a non-place on February 10, 2013. The Defendant reported the above victim’s phone call that the fact of the phone called to the above victim, even if he did not have the KEF 107. As such, even if he did not receive the purchase price, he sent the purchase price to the buyer even though he did not have the intention or ability to deliver the KSF 107. When he sent the purchase price in spite of the fact that he did not have the intention or ability to deliver the SSF 107.

The defendant is 1,400,000 won under the name of the victim's price for the above spacker around 15:2 on the same day from the victim.
