Punishment of the crime

1. The Defendant’s sole criminal conduct did not have any transactional relationship with I or J. However, the Defendant merely borrowed a promissory note issued by the said company for the purpose of temporary financing from K, the representative director of the JBA, and even if such promissory note is distributed, each of the above companies was well aware that it would not pay the said note, and the Defendant did not have any intent or ability to pay the said note.

Nevertheless, around September 14, 2005, the Defendant, at the Defendant’s house of Mapo-gu Seoul Metropolitan Government L Apartment 302, issued a copy of a promissory note with the face value of KRW 33 million issued by the J inain-gu, and through M, the Defendant, through M, made a false statement to the effect that “If the Defendant lends 30 million won to the Jin-gu, he will be paid interest up to 45 days, he shall be paid 33 million won by adding up to interest. It shall be paid on the date of payment without any mold,” and then, he shall receive 30 million won from the above victim as the discount amount of a promissory note.

2. The Defendants’ joint principal offender Defendant A accessed the victim’sO and P, which was in physical color, with the site for a new factory, and introduced the purchase price of six lots, including Chungcheong-gun Q, Q, etc. (hereinafter “instant site”) at KRW 1 billion, but pre-payment and provisional contract amounting to KRW 5 million.

A은 피해자들에게 자신이 에스비에스 방송국 부장 출신으로서 원주에 있는 백화점을 인수하기 위하여 퇴사하였는데 이미 은행담당자들을 상대로 작업을 해두었기 때문에 이 사건 부지를 담보로 17억 원의 대출을 받게 해 줄 수 있고, 피고인 B은 과거 금융기관에 근무한 적이 있는 대출전문가라는 취지로 소개하고, 피고인 B은 피해자들에게 위 부지 매매계약일로부터 1주일 내로 원하는 만큼의 대출을 받게 해 줄 테니 걱정하지 말라는 취지로 이야기하여 피해자들의 환심을 샀다.
