Reasons
1. Basic facts
A. In relation to the F business implemented in Gyeonggi-do, Suwon-si, and Gyeonggi-do, a residential site or commercial site was supplied to the relevant residents as part of the living measures. On June 26, 2009, the residents who became supplied with such a site made a contribution to the said site (right to purchase the site) and began to build a main complex building including neighborhood living facilities and officetels (hereinafter “the instant association”).
B. On June 26, 2009, the above residents held an inaugural general meeting of the instant association and prepared the articles of association of the association (hereinafter “instant association articles of association”), and the main contents of which are as follows.
Article 2 (Purpose) The purpose of the Cooperative is to promote the common interest of members by acquiring land for neighborhood living facilities or commercial land supplied to persons eligible for supply of land for daily countermeasures as part of the daily living measures related to the F projects implemented by Gyeonggi-do, Suwon-si, and Gyeonggi-do Urban Corporation and settling profits and losses from the projects, such as commercial construction, etc.
Article 4 (Methods of Finance and Implementation of Projects) (1) The funds for implementing projects shall be appropriated from the following financial resources:
1. Charges paid by partners for the purchase of land from the construction works;
2. Charges imposed on members, such as construction expenses;
3. The Cooperative may impose and collect expenses necessary for implementing the project from the members, in addition to the provisions of paragraph (1).
(5) Cooperative members' charges falling under each subparagraph of paragraph (1) and money collectible under paragraph (3) shall be borne or collected from cooperative members, but for the smooth implementation of the project, the cooperative shall select a joint executor and a Si construction project (hereinafter referred to as "joint executor") and appropriate funds for lending, and implement the project by creating loans from part of the commercial buildings or financial companies and by making repayment.
