Reasons
A principal lawsuit and a counterclaim shall be deemed simultaneously.
1. The plaintiff filed a claim to confirm the invalidity of the sales contract as the main claim and the cancellation of the sales contract as the conjunctive. The defendant filed a claim to recover the ownership transfer procedure premised on the validity of the sales contract as the counterclaim, and in the case where the sales contract is invalidated or cancelled as the conjunctive, the first instance court dismissed the plaintiff's claim as the main claim, accepted the plaintiff's claim as the main claim, and all of the defendant's claim as the main claim was dismissed.
Since only the defendant appealed, the scope of this Court's trial is limited to the plaintiff's preliminary claim and the defendant's counterclaim.
2. Basic facts
A. 1) Status of the parties, etc. 1) C Commercial Partnership (hereinafter “First Commercial Partnership”)

The second cooperative shall own the ownership of the project site when implementing the joint project for the D living countermeasure site in the "I of the General Living Area within the D Housing Site Development Zone in Suwon-si."
