피고인은 2012. 12. 21. 00:30경 경북 울진군 근남면 수산리 소재 대영모텔 앞 노상에서 (주)테성산업소유 B 엑스트렉승용차량을 울진에서 근남쪽으로 운행하던중 C파출소 경사 D외 1명이 연말연시 음주단속 중 피고인이 운전하던 차량을 정차하여 음주감지기로 피고인의 호흡을 감지한바 만취상태로 감지되어 울진경찰서 C파출소로 임의동행하여 동일 01:10분 1차 음주측정을 요구하였으나 “측정 못해요. 싫어요.”라고 하면서 음주측정을 거부하고, 동일 01:20분 2차 측정을 요구하였으나 “못 붑니다. 안 불어요 죽어도.”라고 하면서 2차 측정도 거부하였으며, 동일 01:30분 3차 측정을 요구하였으나 “못 불어요. 알아서 하세요. 집에 가 자야 돼요. 집에 갈거야.” 라고 하면서 경찰관의 정당한 음주측정을 거부한 자이다.
