A defendant shall be punished by imprisonment for a term of one year and two months.

Punishment of the crime

On September 1, 2016, the Defendant received a summary order of KRW 5 million for a fine of KRW 1 million for a violation of the Road Traffic Act, etc. in the Hongsung Branch of Daejeon District Court on September 1, 2016, and on July 13, 2017, the same court received a summary order of KRW 7 million for a fine of KRW 1 million for a violation of the Road Traffic Act.

1. Crimes committed on October 8, 2018;

A. From October 8, 2018, the Defendant violated the Act on the Aggravated Punishment, etc. of Specific Crimes (Bodily Injury resulting from DSS3 Driving) driven DSS3 automobiles while under the influence of alcohol content 0.281% in front of the CSS station located in Osan-si B on October 8, 2018, and proceeded to E from the far distance of the Osan-si comprehensive sports ground.

Since the place has a lot of traffic of vehicles, the driver of the vehicle has a duty of care to live well in the front and to prevent accidents by accurately manipulating the steering gear.

Nevertheless, under the influence of alcohol, the Defendant was negligent in not operating the steering gear properly, and due to the negligence of the Defendant’s driving ahead of the left part of the Defendant’s vehicle, and the victim F (36 years old) was driving adjacent to the right side of the motor vehicle.

Ultimately, the Defendant, while driving the said SM3 car in a situation where normal driving is difficult due to the influence of drinking, suffered from the injury of the victim F, the victim G (the 43 years old), and H (the 51 years old) who is the passenger of the said SM3 car, respectively, for two weeks of medical treatment.

B. On October 8, 2018, at around 08:59, the Defendant driven a DM3 vehicle under the influence of alcohol content of 0.281% at a section of approximately 500 meters from the first market near Osan City to the roads front of the Cju station located in Osan-si B.

2. On October 11, 2018, around 16:05 on October 11, 2018, the Defendant driven a vehicle with JM520, while under the influence of alcohol by 0.348% of alcohol concentration at the 141 Osan Viewing parking lot, as Osan-si, Osan-si, as well as 16:05.
