A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. On May 16, 2018, around 01:28, the Defendant discovered the victim C who was under influence of alcohol in the south-gu Seoul Southern-ro, Gangnam-gu, Seoul, 2609 case, and stolen the victim C with one cellphone in the possession of the 800,000 won and one photo identification card, two driver's license, two driver's license, Korean credit card, Korean physical card, three cash card, cash receipt card, and one wall in the market value of 100,000 won, each of the new corporate card.
2. Violation of Acts in financial business specializing in fraud and credit finance;
A. On March 18, 2018, the Defendant: (a) purchased tobacco, etc. from D on the street from the time non-fluence; (b) obtained a new physical card in the name of E along with the Defendant’s request; (c) around 02:47 of the same day, the Defendant presented the new physical card in the name of E as if he/she had a legitimate authority to purchase DNA tobacco 5 at the convenience store in the operation of the Victim G in Gangnam-gu Seoul Metropolitan Government, and then acquired and lost it from the above non-name-fluence employees to take over and lost it in the amount of KRW 48,860 of tobacco amounting to KRW 48,860 from the market price, and (d) acquired and lost the total amount of KRW 195,60 from 02:47 to 05:466 of the same day, as shown in attached Table 1 (f) of the same crime.
B. On May 16, 2018, the Defendant: (a) purchased DNA tobacco from the convenience store in the operation of the victim J in Gangnam-gu Seoul, Seoul on May 16, 2018 at the convenience store; (b) presented that he/she had a legitimate authority to complete his/her name in the name of Da with the physical card in the name of Da that was stolen as if he/she had a legitimate authority; and (c) used a stolen physical card from 01:32 to 04:333 of the same day, and (b) was committed in attached Form 3.
