A Imprisonment of 10 months, Defendant B's imprisonment of 6 months, Defendant C's imprisonment of 2 years and Defendant D of 1 year.
Reasons
Punishment of the crime
Defendant A, on February 21, 2012, was sentenced to two years of the suspension of the execution of imprisonment with labor for violating the Petroleum and Petroleum Substitute Fuel Business Act at the Changwon District Court on February 29, 2012, and the said judgment became final and conclusive on February 29, 2012, is currently under suspension of the execution.
1. On March 2013, Defendant A: (a) leased a warehouse at K at the window of Changwon-si, and installed a storage tank, mother pumps, fuel mixture distribution device, etc.; and (b) obtained the proposal from C and D that he/she was aware of the place where he/she manufactured fake petroleum by mixing soben, Toluene, etc.; and (c) accepted the proposal.
Around March 12, 2013, the Defendant, C, and D purchased scam, Toluene, and B, a fake petroleum raw material, from the person under whose name it was named. D made fake petroleum products by mixing the raw material purchased by C with the material purchased by C using the fuel mixture distribution instrument, etc., and the Defendant made contact to L who operated the gas station introduced through the scam to determine the place of delivery after determining the conditions for the trading of fake petroleum, and sold fake petroleum products 200,000 won at the scambling place at the scambridge in Yangsan-si Highway in Yangsan-si, and sold fake petroleum products 20,000 won and 200,000 won, and sold fake petroleum products to the said L in the same manner as on April 6, 2013, and sold fake petroleum products to the 17, 2013 square meters in the name and around 17, 2013.
Accordingly, in collusion with C and D, the Defendant manufactured and sold 41,00 liters of fake petroleum products in a total of 59,220,000 won.
2. Defendant B purchased a total of 10,00 liters of fake petroleum products manufactured as above from D to April 24, 2013 from the above warehouse up to five times in total, from D, and then 18 liters divided it into P 1 ton, and loaded it into P 1 ton on board, and loaded it in Changwon M by dividing it into P twits.
