A defendant shall be punished by imprisonment for not less than eight months.
except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
On February 3, 2012, the Defendant was sentenced to one year of imprisonment and six months of imprisonment in the Ulsan District Court for fraud, etc., and the judgment became final and conclusive on February 11, 2012.
1. On June 3, 2010, from around 15:08 to 16:15 of the same day, the Defendant: (a) had been asked to use C’s name in the course of real estate transaction with D, which was conducted in the process of real estate transaction with D, before May 2009; (b) had been summoned as a suspect in the instant case, and thereafter D had been summoned as a suspect and carried out an investigation by E from a slope in charge of the instant investigation; (c) had been asked to use C’s name on the grounds of the fact that the Defendant was separated from the office of the Jeju Western Police Station and the office of the first economic team in Jeju City; and (d) had the Defendant had been allowed to use C’s name in the process of real estate transaction with D on the grounds of the fact that the Defendant was allowed to use C’s name on the grounds of the fact that the signature was recorded in the “written statement” column and the “written confirmation” column of the investigation process bound by the time, etc., and submitted the date and time and place to each E’s signature.
2. No person who violates the Act on the Registration of Real Estate under Actual Titleholder’s Name shall register any real right to real estate under the name of the title trustee;
Nevertheless, in a situation where it is difficult for the Defendant to trade real estate under the name of the Defendant due to the relationship being multiple times as a criminal case around November 2008, the Defendant, instead of making the name of the registration of the ownership of real estate to be purchased by the Defendant to F, has been made to F, and then, proceeds from resale of the real estate.
