1. With respect to the decision of indirect compulsory performance B between the Plaintiff and the Defendant, the above court official, etc.

1. Facts of recognition;

A. Diplomatic Association located in Gangwon-gun C (hereinafter referred to as “Diplomatic Association”) is a general meeting of the Diplomatic Association of Korea and a branch church affiliated with the plaintiff under its jurisdiction. The defendant, around September 20, 201, was appointed as a member of D church, but was dismissed or withdrawn from the above general meeting on April 18, 2016.

B. On February 12, 2016, the Plaintiff filed an application against the Defendant for a provisional injunction against prohibition of duties and prohibition of entry into and departure from the Chuncheon District Court’s Young Branch Branch 2015Kahap64, and received a decision of dismissal on February 12, 2016. Accordingly, on May 23, 2016, the Plaintiff filed an immediate appeal against Seoul High Court (Chuncheon) 2016Ra5 and rendered a decision of provisional injunction with the purport that “Until the judgment on the merits between the Plaintiff and the Defendant became final and conclusive, the Defendant shall not perform his/her duties as a member of the D branch office of the D branch office, and

다. 원고는 피고를 상대로 춘천지방법원 영월지원 B 간접강제 신청을 하여, 2016. 8. 29. ‘피고가 ㉠㉡의 각 행위를 하여서는 아니 되는 의무를 위반할 때에는 원고에게 위반행위 1회당 50만 원씩을 지급하라’는 내용의 간접강제 결정을 받았고, 위 간접강제결정은 2016. 9. 2. 피고에게 송달되었다. 라.

한편 피고가 제기한 서울고등법원(춘천) 2016카합2 가처분이의 사건에서, 위 나항 기재 가처분결정은 2017. 7. 25. ‘원고와 피고 사이의 본안판결 확정시까지, 피고는 위 ㉠의 행위와 ㉢ D교회 중 별지 도면 표시 가, 나동(D교회 건물 중 담임목사 사택을 제외한 예배당 부분)에 출입하는 행위를 하여서는 아니 된다’는 내용으로 변경되었고, 원고의 신청에 따라 위 2016. 8. 29.자 간접강제결정도 2017. 9. 11. ‘피고가 ㉠㉢의 각 행위를 하여서는 아니 되는 의무를 위반할 때에는 원고에게 위반행위 1회당 50만 원씩을 지급하라’는 내용으로 변경되었다.
