A defendant shall be punished by imprisonment for a term of one year and two months.
Reasons
Punishment of the crime
From April 2012, the Defendant was employed as a contracting position to the Regional Headquarters of the Korea Water Resources Corporation in the victim’s Chungcheong Republic of Korea as a contracting position, and was in charge of vessel management, water quality management, etc. in D, who is affiliated with the said Center.
1. Embezzlements, such as deposits for lease of company houses of the Korea Water Resources Corporation;
A. On June 23, 2014, the Defendant, on the part of the victim Korea Water Resources Corporation D, received a transfer of KRW 90,000,000 from the injured party to use the leased house as the deposit money for the Defendant’s residence. On the 27th day of the same month, the Defendant prepared a contract to lease the said apartment house for the purpose of company house between the owner of F apartment 504,500,000 won and the owner of F apartment 501, and embezzled the said apartment by changing the terms of the contract into “the lease deposit amount of KRW 60,000,000,000,000 won and monthly KRW 3,000,000,000 from the lessor on the 30th day of the same month.”
B. Around April 2016, the Defendant embezzlement of the refund of deposit for lease requested the lessor to preferentially return part of the deposit for lease on the 21st of the same month when the lease contract for the said company house was expired and embezzled by arbitrarily consuming the Defendant’s debt repayment, etc. around that time while receiving a remittance of KRW 5 million from the Defendant’s agricultural bank account to return to the Korea Water Resources Corporation of the victim.
2. The defrauded of the proceeds from the purchase of goods in Korea from around 2015, the Defendant: (a) submitted a false quotation to the victim as if he/she purchased the goods that were not actually purchased; and (b) requested the victim to submit a false quotation to H to the operator of “G”, who is a trader, to use the false quotation; and (c) H to the quotation for the goods that were not actually supplied.
