Reasons
1. Details of the disposition;
A. On October 31, 201, Non-party B (hereinafter “the deceased”) joined the Army and provided an active noncommissioned officer as a supply soldier. On January 1, 2013, Non-Party B, who was assigned to the Army Staff staff at the Army, committed suicide on March 30, 2015, while serving as CJ staff staff, who was on duty at the motherel located in Gangdong-gu Seoul Metropolitan Government.
B. On September 1, 2015, the mother-friendly Plaintiff of the Deceased applied for the registration of bereaved family members of the deceased who died on duty to the Defendant on September 11, 2015 after receiving a decision of death on the deceased’s death from the Ordinary Major Death Review Committee.
C. On December 21, 2015, the Defendant issued a disposition rejecting the registration of bereaved family members and bereaved family members of persons who have rendered distinguished services to the State (hereinafter “instant disposition”) against the Plaintiff on the grounds that “It is difficult to recognize that the deceased died during the performance of military duties or education and training directly related to the national defense, or that the deceased died due to the direct cause for military duties or education and training,” following the deliberation and resolution of the Board of Patriots and Veterans Entitlement.
On January 21, 2016, the Plaintiff appealed to the Central Administrative Appeals Commission, but was dismissed on August 9, 2016.

2. Whether the instant disposition is lawful
A. While the Plaintiff’s assertion was subject to excessive stress compared to that of ordinary dynamics, and such psychological burden was expressed to superior officers, etc., but failed to take appropriate measures from the affiliated unit, the Plaintiff applied for personnel exchange to escape from this, but rather, the personnel exchange was ordered as an excessive unit, which led to suicide due to his or her excessive sense of view and loss. Therefore, in the case of the Deceased, it is evident that the tasks related to his or her duties, etc. were directly caused by the division of duties and normal recognition ability, etc.
