Defendant shall be punished by a fine of KRW 2,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

The defendant is an operator in charge of the business operation who operates a manufacturing business using nine full-time workers, who is located in the Nam-gu, Nam-gu, Seoul. A.

When a worker dies or retires, the employer shall pay the wages, compensations, and all other money and valuables within fourteen days after the cause for such payment occurred.

Provided, That the date may be extended by mutual agreement between the parties in extenuating circumstances.

Nevertheless, the defendant works in the above workplace from June 24, 2016 to November 20, 2018.

A retired worker D did not pay KRW 193,33 of the wages of November 2018 within 14 days from the date of retirement without agreement between the parties to the extension of the due date.

(b) When a worker retires, the employer shall pay the retirement allowance within fourteen days after the cause for such payment occurred; and

Provided, That the date may be extended by mutual agreement between the parties in extenuating circumstances.

Nevertheless, the Defendant worked in the said workplace from January 3, 2005 to June 30, 2018, and paid 19,637,264 won in total, including 12,695,497 won, and 6,941,767 won, from June 14, 2016 to November 20, 2018, and 6,9,637,264 won, within 14 days from the date on which the cause for the payment occurred, without any agreement between the parties on the extension of the due date for payment.
