Reasons

Punishment of the crime

The defendant is the representative of company G G in Gyeyang-gu Incheon, who runs the manufacturing business of motor vehicle products using 20 regular workers.

1. When a worker retires, the employer in violation of the Labor Standards Act shall pay all money and valuables, such as wages, within fourteen days after the cause for such payment occurred;

Nevertheless, the Defendant worked in the said workplace from November 9, 2017 to November 13, 2018, and did not pay 899,166 won monthly wages of H from November 2018 to November 13, 2018, within 14 days from the date of retirement without any agreement between the parties on the extension of the due date.
