A defendant shall be punished by imprisonment with prison labor for up to six months.

Punishment of the crime

1. Fraud;

A. On December 2013, 2013, the Defendant borrowed KRW 200,00,000 to the victim A, who did not bring about money to the victim at the infinite mine-dong, Gwangju.

However, the defendant did not have any particular property at the time, and even if he borrowed money from the injured party due to no certain income, he did not have the intention or ability to repay it.

The Defendant, as such, by deceiving the victim and receiving 200,000 won from the victim, i.e., 20,000 won from the victim, from July 23, 2014, he/she obtained the delivery of KRW 4,250,00 from the victim on a total of 14 occasions, such as the daily list of crimes (1) in attached Form 1.

B. On July 25, 2014, the Defendant: (a) at the home of the victim AB apartment 104 dong 1505, Gwangju Mine-gu, Gwangju, the Defendant would pay the victim the amount of money that the Defendant would lend to the victim with the money that the business operation expenses would be incurred within two to three months.

However, the defendant thought that most of the money borrowed from the injured party was used as a living cost, and there was no particular property at the time, and there was no intention or ability to repay even if he borrowed money from the injured party due to no certain income.

On July 25, 2014, the Defendant, as such, by deceiving the victim, received KRW 2,500,000 from the Defendant’s account under the name of the Defendant from the victim, for the purpose of business funds, from December 25, 2014 to December 2014, the Defendant acquired KRW 61,90,000 in total from the victim on five occasions, such as the previous list of crimes (2).

On August 22, 2014, the Defendant paid an automobile insurance premium to the victim AB apartment No. 104, 1505, and the victim AA to pay it within 2-3 days on the face of the week.
