A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of three years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant is the executive director of the “E” company, the Defendant’s external carin D, whose representative is the Defendant, who actually operates the said company.

On April 24, 2013, the Defendant: (a) produced Twitts in F and E; and (b) concluded a contract with the said F to supply Twitts to G and pay 10% of the price for the goods to E; and (c) concluded a contract with G on April 24, 2013 for the purchase of Twitts.

On July 30, 2013, the Defendant was demanded to submit a clothing test report that guarantees the performance of G’s products, and around July 30, 2013, the Defendant was issued by the Korea Interrogation Laboratory, but did not reach the performance required in G (at least 100 in density, at least 90 in speed, and at least 90 in speed), and was willing to arbitrarily raise the number stated in the test report and submit it to G.

1. On August 2013, 2013, the Defendant: (a) sent a test report in the name of the KDF file in the name of the KDF at the office of “E” located in Dobong-gu Seoul Metropolitan Government H and 401; and (b) sent the test report in the name of the KDF file to “18”; (c) put the test report in the test item “18” from “ 98.4; and (d) put the test report in the “15.2” from “89.8; and (e) stored the test report in the Defendant’s computer. On September 9, 2013, the Defendant instructed the said D to output the above test report.

Accordingly, the Defendant forged the test report under the name of the president of the Korea garment Test Research Institute, which is a private document on proof of facts for the purpose of uttering.

2. On September 9, 2013, the Defendant at the time of the event of the above investigation document is named the name of the president of the Korea garment Test Research Institute, a private document forged as provided in paragraph 1, to the said D, who is aware of the forgery.
