1. The Plaintiff (Counterclaim Defendant) indicated the annexed drawings 1 and 2.2m2 among the land size of 5,962m2 in Full-gun, Jeonnam-do, the Defendant (Counterclaim Plaintiff).
Reasons
A principal lawsuit and a counterclaim shall be deemed simultaneously.
1. Basic facts
A. The Plaintiff is the owner of land owned by the Plaintiff (hereinafter “instant land”) in Jeonnam-gun, Jeonnam-do. The Plaintiff is the owner of land owned by the Plaintiff.
B. The Defendant is the owner of 661 square meters (hereinafter “instant land owned by the Defendant”) and 81 square meters (hereinafter “the instant building owned by the Defendant”) of 135 square meters and 22 square meters of 135 square meters of 2 stories and 135 square meters of 135 square meters of neighborhood living facilities in the 2nd floor of the beando Do-gun, Jeonnam-do, which is adjacent to the instant land owned by the Plaintiff.
다. 이 사건 원고 소유 토지 중 별지 도면 표시 ㄱ, ㅍ, ㅌ, ㅋ, ㅊ, ㅈ, ㅇ, ㅅ, ㅂ, ㅁ의 각 점을 차례로 연결한 선 지상에는 담장(일부는 돌담으로, 일부는 철조망으로 되어 있다. 이하 ‘이 사건 담장’이라 한다)이 설치되어 있고, 이 사건 원고 소유 토지 중 이 사건 담장에 둘러싸인 부분, 즉 별지 도면 표시 ㄱ, ㄴ, ㄷ, ㄹ, ㅁ, ㅂ, ㅅ, ㅇ, ㅈ, ㅊ, ㅋ, ㅌ, ㅍ, ㄱ의 각 점을 차례로 연결한 선내 (가) 부분 87㎡(이하 ‘이 사건 계쟁 토지 부분’이라 한다)는 이 사건 피고 소유 건물의 위요지로서 현재 피고가 점유하고 있으며, 이 사건 계쟁 토지 중 별지 도면 표시 ㄷ, ㄹ, ㅂ, ㅅ, ㄱ¹, ㅎ, ㄷ의 각 점을 차례로 연결한 선내 (라) 부분 29㎡ 지상에는 이 사건 피고 소유 건물 중 일부분(이하 ‘이 사건 계쟁 건물 부분’이라 한다)이 축조되어 있다.

2. Summary of the parties' arguments and issues
A. The gist of the plaintiff's assertion is that the defendant without any title occupies the part of the land in the dispute of this case, which is owned by the plaintiff, without permission, so the part of the building in the dispute of this case.
