A defendant shall be punished by imprisonment for six months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant is a person who is engaged in food manufacturing and processing business under the trade name of “D” in Chungcheongbuk-dong C.

1. No one shall sell foods, etc., import, display, transport such foods, etc. for sale, or use such foods for business purposes, unless the standards for labeling are indicated in accordance with such standards, after determining and publicly notifying the standards for food, drugs, and safety management of foods, etc.

Nevertheless, from around December 15, 2015 to December 15, 2016, the Defendant: (a) supplied approximately KRW 100,000 ton of the total amount of KRW 175,000,000,000,000 ton of the total amount of KRW 100,000,000,000 ton of the total amount of KRW 175,000,00,000; and (b) processed the supplied amount of KRW 250,00,000,000 to G, etc. located in F at the time of economic globalization; and (c) received KRW 960 per kg from G, etc.

As a result, the Defendant used food, etc. for business without marks meeting the standards set by the Minister of Food and Drug Safety.

2. The standards for labeling shall not be sold, imported, displayed, transported for sale, or used for business purposes, unless the standards for labeling are indicated in accordance with such standards, after determining and publicly announcing the standards for the safety of food, drugs, and drugs sold without labeling products;

Nevertheless, around November 2, 2015, the Defendant sold the fished in an amount equivalent to KRW 72,000, which was not indicated in D’s distribution time limit, to G in the Gyeonggi-do Escopic City.

Accordingly, the Defendant sold foods without marks that meet the standards set by the Minister of Food and Drug Safety.

3. Any person who manufactures or processes foods not prepared related to raw material receipts and disbursements shall prepare documents concerning the records of production and work, and documents pertaining to the receipt and delivery of raw materials for storage, delivery, and use of raw materials, and shall keep such documents for three years from the date of the last entry;

Nevertheless, the Defendant from around December 2013 to December 15, 2016.
