The defendant's appeal is dismissed.

The grounds for appeal by the defendant are that the court below's punishment is heavy.

The crime of this case is not likely to be committed by acquiring money from a large number of victims in the name of the purchase price for handphones by raising a writing that the defendant sells false handphones on the Internet and on the Internet website, and the defendant commits the crime of this case within a short period even though he was guilty of the same repeated crime, and there is no effort to recover damage up to now.

However, due to the relationship between fraud, etc. with the judgment and the latter part of Article 37 of the Criminal Act, the principle of equity with the case of being tried at the same time should be considered, and the fact that the amount of damage is not high is favorable.

In full view of these circumstances and the conditions of sentencing as indicated in the record, the lower court’s sentencing is not deemed unfair.
