1. The Defendant had no intention or ability to send a Handphone to another person even if he receives a Handphone from another person, because the Defendant did not have a Handphone to sell it to that person.
A. On April 3, 2016, the Defendant: (a) posted a notice on the Internet Nurier’s “M” camera bulletin board by accessing a PC room located inside the Manan-si, Annyang-si using a PC to sell a Handphone; and (b) sent a 5S handphone to the victim N who reported the above writing to the victim N who made the contact; (c) then, the Defendant received 200,000 won from the victim to the PC account (P) in the same day, from the victim to receive the 5S handphone; and (d) subsequently, the Defendant received the 200,000 won from the victim.
B. On April 4, 2016, the Defendant: (a) made a false statement to the victim Q Q who reported and contacted the Defendant’s 5S sales of the phone posted on the “M” bulletin; (b) received 200,000 won for the purchase price of the Handphone from the victim to the new cooperation account (P) in the name of the director of the company with limited liability on the same day.

On April 5, 2016, the Defendant posted a false statement to the victim R who reported the above writing to have sent a 5S Handphone to the victim R who had sent the 5S Hand phone on the day from the date of deposit to the national bank account (T) account in the name of the State bank (T) in the name of the injured party on the same day. The Defendant received KRW 215,000 as the purchase price for the handphone from the victim to the national bank account (T) account in the name of the State of S.
