A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. 순경 B에 대한 공무집행방해 피고인은 2020. 8. 14. 00:27경 서울 관악구 C에 있는 ‘D’ 앞 노상에서, ‘D 14층 E 나이트에서 삥을 뜯겼다.’는 내용의 112신고를 받고 출동한 서울관악경찰서 F지구대 소속 순경 B이 현장 상황을 확인하고 관련자들의 진술을 청취한 후에 피고인에게 귀가를 권유하자 화가 나서, 큰 소리로 위 경찰관에게 ‘경찰관들이 왜 보호를 안 해 주느냐’고 말하면서 상체로 위 경찰관의 몸통 부위를 수회 밀고, 손으로 손목 부위를 수회 잡아당겨서 폭행하였다.

Accordingly, the Defendant interfered with legitimate execution of duties regarding the handling of 112 reported cases by the police officers, protection of the lives, bodies and property of the people, prevention, suppression and investigation of crimes.

2. At around 01:00 on August 14, 2020, the Defendant damaged public goods, who was arrested as a flagrant offender due to the suspicion of obstruction of performance of official duties in front of the above “D,” and who was escorted to the FF district of the Seoul Gwanak-gu Seoul Special Metropolitan City Police Station located in G, thereby being arrested as a flagrant offender as above, the Defendant: (a) turned out the front part of the driver’s seat of the said patrol while being arrested as a flagrant offender; (b) turned out the front part of the said patrol’s seat; (c) cut off the back part of the auxiliary seat; and (d) destroyed the said patrol vehicle, which is an object used by a public office, by getting out of the rubber wave of the said patrol by hand, with the repair cost of the said patrol’s “Ie-h” and damaged the said patrol vehicle in total of KRW 967,400.

3. The Defendant, on August 14, 2020, arrested and escorted as a flagrant offender at the F District Unit of the Seoul Maak Police Station at the Seoul Maak Police Station at around 01:23, 2020, and then was waiting to go to the Seoul Maak Police Station at the Seoul Maakak Police Station. The Defendant, as a member of the National Assembly, she saw the Defendant as being able to take a large voice, such as “Crewing kid, she is a arro, she is a member of the National Assembly,” and she she was under his/her duty to go to the police officer of the Seoul Maak Police Station F District.
