A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. From around 22:32 on May 19, 2014, the Defendant driven a DNA vehicle with a blood alcohol concentration of about 0.114% while under the influence of alcohol without obtaining a driver’s license at a section of about 200 meters from the front of the “high-speed Power Bureau” in Jung-gu Incheon, Jung-gu, Incheon, to the drinking control site located in front of the “low Urban Cadra”, the Defendant driven a DNA vehicle with a blood alcohol concentration of about 0.114% without obtaining a driver’s license.
2. The Defendant, like the description of Paragraph 1, committed an act of forging private documents, uttering of a falsified investigation document, forgery of a private signature, and the use of a falsified investigation signature, with the aim of evading criminal punishment, presented E’s personal information, which is the denial of the religious pastor of the church where the Defendant was aware of while driving without a drinking license, and led to his mind to do the act as if he were E.
(1) The Defendant stated “E”, “E”, “B”, “E”, “E”, “C”, “E”, “E” and “E” on May 19, 2014 at the time and place of measurement, etc. as indicated in paragraph (1) and marked the Defendant’s name next to the E name.
Accordingly, for the purpose of exercising a certificate of fact, the Defendant forged one copy of the circumstantial statement report in the above E name, which is a private document related to the certification of fact, and exercised it as if it were a document that was duly formed to guard traffic at the Incheon Central Police Station and to the light of the traffic safety system G.
(2) On May 22, 2014, the Defendant entered “E” in the statement column of “A” stating that “I, as the person subject to revocation of a driver’s license, voluntarily make a statement as follows, as the person subject to revocation of a driver’s license,” and then affixed the Defendant’s unmanned seal on the name side of E and submitted the “A” driver’s license continuously.
