1. The Defendant shall pay to the Plaintiff KRW 40,00,000 and the interest rate of KRW 15% per annum from July 20, 2016 to the day of complete payment.

Description of Claim

Article 208(3)3 and Article 194(1) of the Civil Procedure Act of the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings in Part of Time Limit (Decision by Service by Public Notice) to the Plaintiff’s claim against the Defendant for delay payment exceeding the limit of 15% per annum pursuant to Article 2(2) of the Addenda of the same Act (Presidential Decree No. 26553) and Article 2(2) of the Addenda of the same Act, is dismissed.

(Provided, That Article 98 and the proviso to Article 101 of the Civil Procedure Act shall apply to the bearing of litigation costs)
