1. Defendant A shall be punished by imprisonment with prison labor for one year and six months;
However, the above punishment shall be imposed for a period of three years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. No person, other than a business entity or an entrusted business entity, who violates the Seoul Olympic Sports Promotion Foundation or the Seoul Olympic Sports Promotion Foundation in violation of the National Sports Promotion Act, shall give property or property benefits to those who win the result by issuing voting rights for sports promotion or things similar thereto;
Nevertheless, the Defendants issued the so-called “sports soil” that allows the members to participate in betting as a result of the domestic and foreign sports games through an information and communications network, and offered to operate an illegal sports soil website that sets up points to members who win the results.
Defendant
A provides Defendant B with approximately KRW 130 million operating capital, and instruct Defendant B to purchase the Internet site and recruit office employees. Defendant B and C purchased “F (G, H, and I)” from the Internet site producer E, and Defendant B was in charge of the above site management, counseling, and exchange business using four computers together with J, K, L, M, N,O, and P while managing an office located in the city of Vietnam, and Defendant C was in charge of the above site's publicity business using five computers, along with L, N, R, S, and T.
As the Defendants changed the address of the above site from March 29, 2016 to April 30, 2016 from the above two places to “UV,” etc., the Defendants received KRW 300,000 from members W, a new bank Y account under the name of X of a limited company under the name of points in terms of points payment, and received KRW 281,685,600 in total from members as points payment as indicated in the attached list of crimes in the attached list of crimes, and caused them to accumulate points in accordance with the dividend rate, and otherwise, if they enter the result of betting, they lose points.
