A defendant shall be punished by imprisonment for one year.

Punishment of the crime

On November 25, 2011, the Defendant was sentenced to six months of imprisonment for fraud in the Gwangju District Court's Netcheon Branch, and completed the execution of the sentence in the Gwangju Prison on March 16, 2012.

"2013 Highest 3180"

1. On August 13, 2013, the Defendant sent a letter to the effect that, around August 13, 2013, the Defendant: (a) puts up a letter on the Internet NAV car page that, on August 15, 2013, the victim C asks for four diskettes of the LG Han Han-si games “on August 15, 2013; and (b) if the Defendant’s cell phone deposits KRW 70,000 won to the victim, the Defendant would sell the ticket.”

However, in fact, the defendant did not have the above field diskettes at the time, so even if he received money from the victim, he did not have the intention or ability to issue the field pockets.

The Defendant, by deceiving the victim as such, received 70,000 won from a new bank account (Account Number: D) in the name of the Defendant under the name of the victim for the purchase of diskettes.

2. On August 24, 2013, the Defendant sent letters to the effect that, on August 24, 2013, the Defendant: (a) posted the phrase “A victim E purchases the uniform of a military officer” on the Internet Neneber Cine; and (b) sent 1.20,000 won to the victim via the Defendant’s mobile phone, via the Defendant’s cell phone, the Defendant sent the victim a letter “I will send it to the Defendant’s home uniform of the Army officer.”

However, the defendant did not have any intention or ability to deliver a uniform to the Army officer even if he received money from the victim, because the defendant did not receive money from the above Army officer.

The Defendant, as such, by deceiving the victim, received KRW 120,000 from the victim via a new bank account (Account Number: D) under the name of the Defendant under the pretext of the full return of officers in the Army.

3. On August 14, 2013, the Defendant: (a) on August 14, 2013, puts down a letter stating that “The Victim F would purchase four tickets in the Daegu Yung-gu YUF” on the Internet NAV car page at around 11:57.
