A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. On June 4, 2015, the Defendant: (a) committed theft on June 4, 2015, which was operated by the Victim C in Ansan-si, Ansan-si; (b) on June 4, 2015, the Defendant stolen the victim’s property in the sum amounting to KRW 580,000,000, in total, of portable card terminals, security cards, and credit cards, etc., owned by the victim C, who opened and intrudes into the D cafeteria-si, Ansan-si; and (c) brought about a cash amounting to KRW 180,000,000 in the market price.
2. On June 9, 2015, the Defendant attempted to larceny at night buildings: (a) around 04:10 on June 9, 2015, the Defendant: (b) opened a toilet window at the same time and installed for the purpose of the net crime prevention of entry into the inside, without having a locking device, to steal property by entering the “G” restaurant operated by the victim F of the victim F in Ansan-si, Ansan-si; (c) and (d) did not commit an attempted escape.
3. On June 13, 2015, at around 05:16, June 13, 2015, the Defendant: (a) destroyed the rectification device by cutting off water from the main window to the heating unit and drilling the hole, and then then invaded into the said restaurant, thereby destroying the cash owned by the victim; (b) KRW 70,000; and (c) thief’s passbook, etc., the Defendant stolen the victim’s property at the “J” restaurant operated by the victim I in Ansan-gu, Ansan-si, Ansan-si; and (d) stolen the victim’s property.
4. On June 13, 2015, at around 08:34, Jun. 13, 2015, 2015, the Defendant: (a) collected i.e., passbook Nos. 1, which had been stolen as provided in paragraph (1) from the victim Nonghyup Bank established at the victim Nonghyup Bank, which had been located there, in his/her main road, in a cash withdrawal machine managed by the victim; and (b) withdrawn 280,000 won in cash and stolen 280,000 won in cash.
5. On June 15, 2015, at night, the Defendant for larceny of a structure: (a) around 04:02 on June 15, 2015, at the “M” restaurant operated by the victim L in Ansan-gu, Ansan-si, Ansan-si; (b) the main window is shaking off in his/her hand.
