A defendant shall be punished by imprisonment for six months.

However, the execution of the above sentence shall be suspended for a period of one year from the date this judgment becomes final and conclusive.

Punishment of the crime

피고인은 2020. 10. 13. 23:05 경 김해시 B에 있는 C 편의점 앞에서, ‘5 명 정도가 싸움을 한다’ 는 112 신고를 받고 출동한 김해서 부 경찰서 D 지구대 소속 순경 E이 피고인의 몸을 잡았다는 이유로 욕설을 하면서 발로 그의 정강이 부위를 1회 걷어차고, 이에 순경 E, 순경 F이 피고인을 현행범으로 체포하여 순찰차에 태우자 욕설을 하면서 발로 순경 F의 왼쪽 어깨 부위를 1회 걷어찼다.

계속해서 피고인은 김해시에 있는 D 지구대에 도착한 다음 그곳에서 피고 인의 다친 부위를 촬영하는 순경 G의 턱 부위를 발로 1회 걷어찼다.

Accordingly, the defendant interfered with the legitimate execution of duties by police officers concerning 112 reporting process and arrest and management of flagrant offenders.

Summary of Evidence

1. Statement by the defendant in court;

1. Application of Acts and subordinate statutes on police statements made to E, F and G;

1. Relevant provisions of the Criminal Act and Article 136 (1) of the Criminal Act concerning facts constituting a crime. Article 136 (1) of the same Act concerning the selection of punishment;

1. The former part of Article 37 of the Criminal Act, and Articles 38 (1) 2 and 50 of the same Act, which aggravated concurrent crimes;

1. Article 62 (1) of the Criminal Act on the suspended execution;

1. The crime of this case on the grounds of sentencing under Article 62-2 of the Social Service Order Criminal Act is not likely to be committed by assaulting police officers who properly perform official duties, and considering the fact that police officers did not receive a letter of suspicion from the victimized police officers, the defendant's responsibility is heavier.

However, it is reasonable to consider that the defendant is the first offender, and that he reflects his wrong.

The punishment as ordered shall be determined by comprehensively taking into account the following circumstances, including the Defendant’s age, sex, environment, the background and consequence of the instant crime, the circumstances after the commission of the crime, and all the sentencing factors shown in the arguments and records.
