A defendant shall be punished by imprisonment for not less than eight months.
Reasons
Punishment of the crime
1. On January 10, 2015, the Defendant forged a private document: (a) at the office of Seo-gu in Gwangju, Seo-gu, Gwangju; (b) on the gold column for guarantee of the form of a real estate lease agreement for an apartment building of 102 Dong 502 and 502, the Defendant stated “One million won (one hundred million won)”; and (c) on the lessor column, the Defendant stamped the seal of D; and (d) on the next page, the lessee’s address in the lessee column; and (d) on the lessee column, the Defendant stated the name “G”, “H”, “H”, and “I”, and had a prior possession of the private document immediately thereafter; and (d) written the name “I”.
I’s seal affixed, and signed and possessed in advance the leased guarantee column for the leased lease report form issued by the Victim Bable Savings Bank, Inc., the “FI” and “FI” in the lessee column.
I have affixed his seal.
Accordingly, the defendant, who is a private document on the duty of rights, has regulated the lease contract and the lease contract report on the above apartment in the name of the I.
2. On January 13, 2015, the Defendant: (a) filed an application for a general loan with the J, who is an employee in charge at the head office of the Victim Bable Savings Bank located in the Dong-gu, Gwangju-gu, Gwangju-gu, Seoul-do; (b) presented the forged real estate lease agreement and the lease agreement report as if they were genuine.
3. The Defendant: (a) leased an apartment building E, No. 102 Dong 502 to the said I and paid the leased deposit amount of KRW 90 million to the said I; (b) however, as I leased an apartment building of KRW 10 million, I applied for a forged real estate lease agreement and a report on the lease agreement, which was forged as if I leased the apartment, by submitting a false real estate lease agreement and the report on the lease agreement to the J, who is an employee of the Victim Bable Savings Bank, and was paid KRW 75 million on January 14, 2015 from the damaged person as the account in the name of the Defendant.
Accordingly, the defendant deceivings the victim and defrauds the victim 75 million won.
