1. The plaintiff's claims against the defendants are all dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Basic facts

A. The Plaintiff entered into an insurance contract (hereinafter “instant No. 1 insurance”) with Defendant Samsung Life Insurance Co., Ltd. (hereinafter “Ssung Life Insurance Co., Ltd.,” and the Plaintiff entered into an insurance contract (hereinafter “instant No. 2 insurance”) as listed in the following table 2 and 3 (hereinafter “this case’s No. 2 insurance contract” and No. 3 as listed in the table 2 and No. 3) with Defendant interesting State Life Insurance Co., Ltd. (hereinafter “S interesting State Life Insurance Co., Ltd.”).

Serial No. 26, May 26, 2001, No. 10,000 of the Plaintiff’s life annuity No. 3,000,000 for non-payment for non-payment type No. 3,000,000 for the Plaintiff’s life insurance on September 30, 2038, the details of ensuring the maturity of the insured on the date of the purchase insurance contract (unit: KRW 10,000 for non-payment type No. 3,00,000 for the Plaintiff’s life annuity No. 10,000 for non-payment type No. 30,000 for non-payment type insurance on July 18, 2003, the Plaintiff’s life annuity No. 10,000 for non-payment type 10,000,000 for the Plaintiff’s life annuity No. 30,000 for non-payment type insurance on September 30, 2003

B. The main contents of the instant 1 insurance clause are as follows.

Article 9(Definition and Diagnosis Confirmation of "Cance") (1) The term "Cance" in this Agreement means diseases (see attached Table 3, e.g., Table 3) classified as malicious life in the basic classification of the Korean Standard Classification of Disease Patients.

(2) The diagnosis and confirmation of cancer shall be made by a person who holds a professional doctor's license of autopsy pathology or clinical pathology, and this diagnosis shall be based on the present opinion on organization or blood examination.

However, if it is not possible to conduct the above pathological diagnosis, the clinical diagnosis of cancer is admitted as evidence of cancer.
