Defendant shall be punished by imprisonment for a year and February of one year and a fine of KRW 3,000,000.

Provided, That the above punishment shall be imposed for three years from the date this judgment became final and conclusive.

Reasons

Punishment of the crime

피고인은 한의사가 아니면 한방의료행위를 할 수 없음에도 불구하고 영리를 목적으로, 2007. 1. 8.경 안산시 단원구 D, 5동 105호에서 침, 부황기구, 쑥뜸 등을 구비해놓고 그 곳을 찾아온 E에게 머리가 좋아지고 불균형한 상반신을 균형 잡히게 해주는 치료를 한다며 가슴과 복부에 침, 부항, 쑥뜸을 놓아주고 치료비 명목으로 30만 원을 받은 것을 비롯하여 그 무렵부터 2014. 7. 5.경까지 별지 범죄일람표 기재와 같이 위 E과 그의 가족인 F, G, H에게 침, 부항, 쑥뜸 등의 치료를 해주고 한약을 조제하여 주는 등의 행위를 하고 그 대가로 합계 9,960만 원을 교부받아 한방의료행위를 업으로 하였다.
