1. The remainder of the amount calculated by deducting the auction expenses from the proceeds by selling the 2474m2 to the auction at the Namyang-si, Namyang-si.
Reasons
1. Facts of recognition;
A. At the time of the division, Q&A forest 49,488 square meters (hereinafter “the forest before division”) was originally owned by R’s father, who is the father of R.
On September 12, 1997, the forest land before subdivision was divided into Q forest 24,744 square meters (hereinafter “ Q forest after subdivision”) and the forest land of this case 24,744 square meters.
B. On December 17, 1979, T and U purchased the land before subdivision from R, an administrator of S, an absentee, through V and W, and completed the registration of ownership transfer based on sale and purchase on December 19, 1979.
C. On March 28, 1985, R completed a provisional registration on March 23, 1985 with respect to the portion of U-owned 49,48/48/49,74 of the land before subdivisions, which was based on the purchase and sale reservation. On June 3, 1997, R completed the registration of ownership transfer based on the provisional registration on April 1, 1997.
After T on March 10, 1995, after the co-inheritors died on March 10, 1995, X-Y, Z, AA, Defendant D, F, and C (hereinafter “T’s property heir”) among co-inheritorss completed the registration of transfer of ownership by agreement on March 10, 1995 as shown in the attached Table with respect to their share 24,748/4 of the land before the split-off on August 12, 1995.
E. After division, as to the shares of 49,488/49,74 of T’s 49,488 and shares of 24,744/48 of T’s 49,48 among the forest land in this case, the registration of ownership transfer was completed as shown in the attached Table No. H, non-party AB, AC, P, Defendant E, D, Selectioner,O, L, K, K, non-party D, Defendant F, and C.
However, AC died on March 22, 2005, and there was a wife AE, children J, and AF as co-inheritors, but the selected, who was the child, succeeded to AC’s shares by agreement division.
