A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

Punishment of the crime

On April 26, 2007, the Defendant was sentenced to a suspended sentence of ten months for a violation of the Labor Standards Act at the Suwon District Court, and the said judgment was finalized on May 4, 2007.

C Co., Ltd. had an office in Gyeonggi-gun Group D and E Co., Ltd. is a corporation engaged in logistics transportation business, and P Co., Ltd. used the name “G” from March 2006 to May 2006, to use the name “G” as the head of C, H is the actual operator of C, and the Defendant served as the representative director from September 2002 to April 26, 2006.

On April 2006, the Defendant concluded a cargo distribution contract with I, the nominal representative director of C, and conspiredd to transport E products through C with the introduction of F. The Defendant and H and F, through C, by deceiving the victims who want to purchase five tons of wing wing truck and transport E, thereby deceiving them to acquire the cost of purchasing the cargo vehicle.

F The Chief Justice J Co., Ltd. stated that “A vehicle needs to be moved to C due to the increase of fixed logistics delivery vehicles in the E Company, and therefore, J recruited the branch owner and connected to C, and the purchase of the main vehicle and the dispatch contract will be responsible for C,” thereby allowing K to publish an advertisement for recruitment of the branch-in vehicle in the name of J in the area of local living information.

At the C office on April 28, 2006, F and H made a false statement to the victim L, who reported the advertisement, introduced C by contact with the J, and visited C, stating that “If you purchase the cargo vehicle through C, you will deliver the species of the species of the species from E to E, the Seoul Metropolitan area, the electric franchise, and the commercial franchise route to deliver the species of the species of the species from E. The payment of the vehicle will provide monthly pay of 3.2 million won per month and all oil expenses.”

However, at the time, E’s production was suspended due to the financial shortage, and the defendant, H, and F purchase cargo from the victim even if they receive the purchase price of the cargo from the victim, or intent or ability to take such job as above.
